Hyderabad: The Telangana High Court has allowed the government to continue the tender process for supplying eggs to Anganwadis and government schools across the state. It also dismissed a petition challenging the award of tenders and imposed a penalty of Rs 1 lakh on the petitioner.
Sirifarms of Ibrahimpatnam in Ranga Reddy district filed the case, questioning the award of the tender to M.A. Poultry and Feed for the period from September 1 this year to August 31 next year. Justice Nagesh Bheemapaka heard the matter and delivered the verdict.
Court rules technical objections cannot block lowest bid tenders
The petitioner’s counsel argued that the selected company had failed to meet tender conditions. However, the government’s counsel responded that the decision was based on the quoted price. Although some documents were missing during verification, the company later submitted them.
After hearing both sides, the judge observed that tenders meant to save public money should not be rejected on minor technical grounds. He ruled that the lowest bidder had the right to supply and that documents provided during verification must be considered. Moreover, he noted that the court could not intervene without evidence of financial loss to the government. Consequently, the court dismissed the petition and fined the petitioner Rs 1 lakh for attempting to obstruct the process.
