Hyderabad: BRS president and former Chief Minister K. Chandrashekar Rao criticised the Special Investigation Team for serving him a notice, calling the move a clear violation of legal procedure and constitutional norms.
In a detailed response, KCR said he had already informed authorities that he resides in Erravelli village. Despite this, SIT officials pasted the notice on the gate of his Nandinagar residence. Therefore, he described the action as a breach of his constitutional rights and a disregard for due legal process.
KCR said the notice violated Section 160 of the Criminal Procedure Code. He stated that the law requires questioning of individuals above 65 years at their place of residence. “I am over 70 years old and have been living in Erravelli for several years,” he said.
KCR SIT notice challenged citing Supreme Court guidelines
Referring to the Supreme Court judgment in Satender Kumar Antil vs CBI, KCR said notices must be served personally. He added that the apex court clearly barred service through WhatsApp or by pasting notices at random locations. Consequently, he argued that the SIT failed to follow binding judicial directions.
KCR also claimed that the SIT had no jurisdiction over him. He said he does not fall under the limits of the police station that issued the notice. Therefore, he asserted that the notice carried no legal validity and amounted to contempt of court.
Highlighting what he called inconsistent enforcement, KCR pointed out that the SIT served Minister Harish Rao in Hyderabad despite his official address being in Siddipet. According to him, this reflected a clear double standard in the application of the law.
Rejecting the second notice outright, KCR described the SIT’s actions as politically motivated and unlawful. He warned that ignoring constitutional safeguards and Supreme Court rulings would set a dangerous precedent for democratic institutions.
