New Delhi: NHAI arbitration defence strategy delivered major results as the Authority secured favourable net awards in two high-value disputes linked to the Panipat–Jalandhar section of NH-44. The tribunal ruled in favour of NHAI after detailed hearings. As a result, the decision protected public funds.
The disputes involved claims exceeding ₹8,375 crore from concessionaires. They demanded termination payments, toll revenue losses, escalation costs and delay compensation. In addition, they raised prolongation and other financial claims. NHAI strongly contested all major demands.
The arbitration tribunal examined contracts, records and expert evidence. Moreover, it reviewed counterclaims filed by NHAI. After full evaluation, the tribunal accepted key arguments of the Authority. It rejected several large monetary claims.
In the first case, claimants sought over ₹5,443 crore. They cited alleged toll losses and termination disputes. However, NHAI maintained that termination followed contractual defaults. Therefore, it denied liability. The tribunal upheld this defence and passed a net award of ₹115.73 crore in favour of NHAI.
The second dispute involved claims exceeding ₹2,931.79 crore. The claimant alleged delay losses, escalation expenses and idling costs. Nevertheless, NHAI argued that the claims lacked contractual support and proper evidence. After review, the tribunal rejected major claims and awarded ₹704.23 crore to NHAI.
NHAI arbitration defence results in net award of ₹819.96 crore
The combined outcome of both cases strengthened the NHAI arbitration defence approach. After adjustment of claims and counterclaims, the tribunal delivered a total net award of ₹819.96 crore in favour of NHAI. The Authority also faced counterclaims worth ₹2,888.64 crore, which the tribunal evaluated during proceedings.
Earlier, NHAI successfully defended another arbitration case related to the Kamrej–Chalthan section of NH-48 in Gujarat. In that matter, the contractor claimed ₹174.49 crore. However, the tribunal awarded only ₹54 lakh. This further reflected the Authority’s legal position.
NHAI stated that these outcomes reinforce strict contract enforcement. The Authority added that it will continue to safeguard public funds. It will also ensure accountability and transparency in highway development projects.
